By accessing our website, booking an appointment, or receiving treatment, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

These Terms should be read in conjunction with our Privacy Policy, which explains how we collect, use, and protect your personal information.

2. Website Use

2.1 Permitted Use

You may use our website for:

• Browsing information about our services and treatments
• Making enquiries and booking appointments
• Accessing educational content about cosmetic procedures
• Contacting us for support or information

2.2 Prohibited Use

You must not:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Copy, reproduce, or distribute our content without permission
• Submit false or misleading information
• Interfere with the proper functioning of the website

2.3 Age Restriction

Our website and services are intended for users aged 18 years and over. Persons under 18 may only access our services with parental or guardian consent and supervision.

3. Treatment Services

3.1 Consultations

All treatments require an initial consultation with our qualified practitioners. During the consultation, we will assess your suitability for treatment, discuss your goals, explain risks and expected outcomes, and obtain informed consent.

3.2 Treatment Suitability

We reserve the right to refuse treatment if we determine it is not suitable for you, not in your best interest, or if you do not meet our eligibility criteria. Our practitioners' clinical judgment is final.

3.3 Informed Consent

Before any treatment, you must:

• Provide accurate and complete medical history
• Disclose all medications, supplements, and allergies
• Inform us of any changes to your health since your last visit
• Read and sign the relevant consent forms
• Ask any questions you may have about the procedure

3.4 Results

Individual results vary and cannot be guaranteed. Before and after images on our website and materials are for illustrative purposes only and may not reflect typical results. Treatment outcomes depend on individual factors including skin type, age, lifestyle, and adherence to aftercare instructions.

4. Bookings and Cancellations

4.1 Making a Booking

Appointments can be made online, by phone (1800 DERMAQ), or in person. A booking constitutes acceptance of these Terms.

4.2 Cancellation Policy

We understand plans change. Our cancellation policy is:

• More than 24 hours notice: No fee applies
• Less than 24 hours notice: A cancellation fee may apply
• No-show: Full appointment fee may be charged

To cancel or reschedule, please contact us as soon as possible via phone or email.

4.3 Late Arrivals

If you arrive more than 15 minutes late, we may need to reschedule your appointment to ensure adequate time for your treatment and subsequent appointments.

4.4 Our Right to Cancel

We reserve the right to cancel or reschedule appointments due to unforeseen circumstances, staff illness, or emergencies. We will provide as much notice as possible and work with you to find an alternative time.

5. Payments and Pricing

5.1 Pricing

All prices are displayed in Australian dollars (AUD) and include GST where applicable. Prices are subject to change without notice. The price quoted at the time of booking will be honored for that appointment.

5.2 Payment Methods

We accept:

• Cash
• Credit and debit cards (Visa, Mastercard, American Express)
• EFTPOS
• Afterpay
• Zip Pay
• Gift cards and vouchers issued by Dermaq

5.3 Payment Terms

Full payment is required at the time of service unless otherwise agreed in writing. We do not offer credit facilities.

5.4 Refunds

Due to the nature of cosmetic treatments, refunds are generally not provided once a treatment has been performed. If you are dissatisfied with your treatment, please contact us to discuss your concerns. We are committed to achieving your satisfaction and may offer complementary review appointments or adjustments where clinically appropriate.

6. Rewards Program

6.1 Program Overview

The Dermaq Rewards Program allows eligible members to earn points on qualifying purchases which can be redeemed for discounts on future treatments.

6.2 Eligibility

To participate in the Rewards Program, you must:

• Be aged 18 years or over
• Be an existing Dermaq client
• Provide valid contact information
• Agree to these Terms and Conditions

6.3 Earning Points

• Points are earned on eligible treatments and product purchases
• The earning rate will be communicated at the time of enrollment or purchase
• Points are not earned on gift card purchases, promotional items, or third-party products
• Points are credited to your account after the transaction is complete

6.4 Redeeming Points

• Points can be redeemed for discounts on treatments and eligible products
• Minimum redemption thresholds may apply
• Points have no cash value and cannot be exchanged for cash
• Points cannot be transferred to another member
• Redeemed points cannot be reinstated

6.5 Points Expiry

Points expire 24 months from the date they were earned if there is no account activity (earning or redeeming) during that period. We will send a reminder before points expire.

6.6 Account Management

• You are responsible for keeping your contact details up to date
• Points balances can be checked by contacting our clinics
• Points adjustments may be made to correct errors or fraudulent activity

6.7 Program Changes

We reserve the right to modify, suspend, or terminate the Rewards Program at any time. We will provide reasonable notice of material changes. Any points earned before termination may be redeemed within 90 days of termination notice.

7. Referral Program

7.1 Eligibility

The Referral Program is open to all existing customers ("Referrers") and their referred friends ("Referred Friends"). The Referrer must be a current customer, and the Referred Friend must be a new customer who has not previously received services from us.

7.2 Referral Reward

Both the Referrer and the Referred Friend will each receive a $50 discount on their treatment. The discount is non-transferable and cannot be exchanged for cash.

7.3 How to Redeem

The Referrer must identify themselves and their Referred Friend at the time the Referred Friend books their first treatment. The Referred Friend must then complete their treatment for both parties to receive the $50 discount on their respective treatments.

7.4 Limitations

• The Referred Friend can only be referred once and receive one $50 discount
• The Referrer can refer multiple friends and will receive a $50 discount for each successful referral, with no upper limit on the number of referrals
• Discounts can be redeemed at any time and do not expire
• Discounts cannot be combined with any other promotions or offers

7.5 General Conditions

We reserve the right to modify or terminate the Referral Program at any time without prior notice due to changing operational conditions, the occurrence of fraud, or any other reasons. By participating, both the Referrer and the Referred Friend agree to these terms.

7.6 Liability

We are not responsible for incorrect information provided by customers, technical malfunctions, or lost/delayed data transmission which may limit an individual's ability to participate in this program.

8. Gift Cards

8.1 Purchase and Use

• Gift cards can be purchased online or at our clinics
• Gift cards are redeemable for treatments and eligible products
• Gift cards cannot be redeemed for cash or refunded
• Lost, stolen, or damaged gift cards cannot be replaced

8.2 Validity

In accordance with Australian Consumer Law, gift cards are valid for a minimum of 3 years from the date of purchase. The expiry date is printed on the gift card or provided at the time of purchase.

8.3 Redemption

If the treatment cost exceeds the gift card value, the balance must be paid using another payment method. If the gift card value exceeds the treatment cost, the remaining balance will stay on the card for future use.

9. Medical Disclaimers

9.1 Not Medical Advice

The information on our website is for general informational purposes only and does not constitute medical advice. It is not intended to replace consultation with a qualified healthcare professional.

9.2 TGA Compliance

In accordance with the Therapeutic Goods Administration (TGA) regulations, we do not advertise specific prescription medicines or make claims about therapeutic benefits. All treatments are discussed during private consultations with qualified practitioners.

9.3 Risks and Complications

All cosmetic procedures carry inherent risks. Potential complications will be discussed during your consultation and detailed in consent forms. It is your responsibility to disclose all relevant medical information and follow pre and post-treatment instructions.

9.4 Cooling-Off Period

In accordance with Australian guidelines for cosmetic procedures, a cooling-off period may be required between consultation and treatment for certain procedures. This allows you time to consider the information provided and make an informed decision.

10. Intellectual Property

10.1 Ownership

All content on our website, including text, images, graphics, logos, videos, and software, is owned by or licensed to Dermaq Aesthetics and is protected by Australian and international intellectual property laws.

10.2 Limited License

You may view, download, and print content from our website for personal, non-commercial use only. You must not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content without our prior written consent.

10.3 Trademarks

The Dermaq name, logo, and related trademarks are our property. Use of these marks without written permission is prohibited.

11. Limitation of Liability

11.1 Website Use

Our website is provided on an "as is" basis. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. To the maximum extent permitted by law, we exclude all warranties, representations, and guarantees relating to the website.

11.2 Treatment Services

While we strive to provide high-quality services, outcomes cannot be guaranteed. Our liability for any claim relating to treatment services is limited to the cost of the treatment provided or re-performance of the service, at our discretion.

11.3 Exclusions

To the maximum extent permitted by law, we are not liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Outcomes that differ from expectations where appropriate care was provided
• Complications arising from undisclosed medical conditions or medications
• Failure to follow pre or post-treatment instructions

11.4 Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

12. Indemnity

You agree to indemnify and hold harmless Dermaq Aesthetics, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms, your use of our services, or your violation of any rights of another party.

13. Disputes and Complaints

13.1 Resolution Process

If you have a complaint or dispute, we encourage you to:

• Allow us the opportunity to investigate and respond
• Work with us to find a mutually acceptable resolution

13.2 External Resolution

If we cannot resolve your complaint to your satisfaction, you may contact the relevant regulatory or consumer protection bodies in Victoria.

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising from these Terms or your use of our services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
